Employment discrimination because of cultural characteristics related to race or ethnicity. TitleRead More VII prohibits employment discrimination against a person because of cultural characteristics often linked to race or ethnicity, such as a person’s name,(18) cultural dress and grooming practices,(19) or accent or manner of speech. For example, an employment decision based on a person having a so-called “Black accent,” or “sounding White,” violates Title VII if the accent or manner of speech does not materially interfere with the ability to perform job duties. Here’s the list of states that provide employment protections to smokers, according to the American Lung Association: ◾California ◾Colorado ◾Connecticut ◾District of Columbia ◾Illinois ◾Indiana ◾Kentucky ◾Louisiana ◾Maine ◾Minnesota ◾Mississippi ◾Missouri ◾Montana ◾Nevada ◾New Hampshire ◾New Jersey ◾New Mexico ◾New York ◾North Carolina ◾North Dakota ◾Oklahoma ◾Oregon ◾Rhode Island ◾South Carolina ◾South Dakota ◾Tennessee ◾Virginia ◾West Virginia ◾Wisconsin ◾Wyoming
